• By purchasing, you agree to our privacy policy and acceptable use terms, including the following Agreement between us ("Seller") and you ("Buyer"):
  • Seller represents and warrants that the Lead Information was gathered lawfully from publicly available sources in compliance with all applicable laws, regulations, and industry standards at the time of collection.
  • Seller does not guarantee the accuracy, completeness, or current validity of the Lead Information, including but not limited to the business names, email addresses, or the identity of the principal owners. 
  • Seller makes no representations or warranties regarding the responsiveness of any individual or entity included in the Lead Information to Buyer’s marketing efforts or any other use by Buyer.
  • Buyer acknowledges that the success of any marketing or outreach efforts using the Lead Information is not guaranteed and depends on factors beyond Seller’s control.
  • Seller disclaims any and all liability for Buyer’s use, disuse, or misuse of the Lead Information, including but not limited to any financial losses, legal claims, or damages arising from Buyer’s actions or reliance on the Lead Information.
  • Buyer agrees to indemnify, defend, and hold harmless Seller from any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising out of or related to Buyer’s use of the Lead Information.
  • Seller shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, revenue, data, or data use. Seller’s maximum liability for any damages arising out of or related to this Agreement, whether in contract or tort, or otherwise, shall be limited to the amount of the fees Buyer paid to Seller under this Agreement.
  • Buyer agrees to use the Lead Information in strict compliance with all applicable local, state, federal, and international laws, including but not limited to data protection, privacy, and anti-spam laws (e.g., CAN-SPAM Act, GDPR, or other relevant regulations).
  • Buyer shall be solely responsible for ensuring that its marketing practices and use of the Lead Information comply with all legal requirements.
  • Upon full payment of the Purchase Price, Seller grants Buyer a non-exclusive, non-transferable license to use the Lead Information solely for Buyer’s internal marketing purposes.
  • Buyer shall not resell, redistribute, or share the Lead Information with any third party without prior written consent from Seller.
  • This sale shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without regard to its conflict of law principles.
  • Any controversy or claim arising out of or relating to this sale or the breach thereof shall be settled by arbitration in accordance with the Uniform Rules for Binding Arbitration of the Better Business Bureau serving Metro Washington DC, Metro Philadelphia & Eastern Pennsylvania in effect at the time of initiation of arbitration, and the judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
  • If any provision of this sale or terms and conditions are found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
